Not in the Free World, I believe.

For those who are unfortunate enough to live in places like the USA which do
permit patenting of such things, presumably the manufacturer of the modem is
paying a royalty to the patent holder for each unit shipped, so it's
possible that when you buy the hardware, it comes with an implicit licence
to use these algorithms on it, regardless of where you got the driver
software you actually use.
